Terms and conditions, site usage rules and advertising conditions for Photo Collective (photocollective.com.au) owned by PHOTO COLLECTIVE PTY LTD.
1. Defined Terms
1.1 In use of www.photocollective.com.au (Website) operated by Photo Collective (Promoter), users (Users) agree to the following terms.
1.2 The Website is an online content hosting platform which showcases photographs (Images) made by Photographers (Artists) through online articles (Posts).
1.3 Users can browse the Images and read about photography in the Posts.
2. Site Use
2.1 Users of this website agree to be bound by these terms and conditions, which are subject to change at the discretion of Photo Collective. Your use of and access to this site indicate your acceptance of these terms and conditions.
2.2 All intellectual property in relation to material included on this site belongs to Photo Collective or its licensors or advertisers, and Users obtain no interest in that property.
2.3 All material on this site is protected by Australian and international copyright and other intellectual property laws. Users may not do anything which interferes with or breaches those laws or the intellectual property rights in the material.
2.4 Users may download and view the material or print a copy of material on this site for personal, non-commercial use provided you do not modify the copy from how it appears on this site (including any copyright notice). All rights not expressly granted under these terms of use are reserved.
2.5 This site may include third party content which is subject to that third party’s terms and conditions of use.
2.6 This site may include links to third party sites which are not related to Photo Collective and in relation to which Photo Collective has no control or interest. Those links do not indicate any relationship between Photo Collective and that third party or any endorsement by Photo Collective of that third party, its site or the products or services which it is advertising on this site.
2.7 Photo Collective will have no responsibility or liability in relation to any loss or damage which you incur, including damage to your software or hardware, arising from your use of or access to this site.
2.8 Users will not use this site for any purpose or in any way which is unlawful.
3. User Generated Content
Photo Collective welcomes the general public to provide content in the form of comments, still photographs, video, stories and other types of user-generated content for publishing to our websites and print publications.
Only content that complies with the following terms and conditions is eligible for publishing.
3.1 If you submit content to Photo Collective, you agree to be bound by these terms and conditions. These terms and conditions are subject to change at any time.
3.2 Photo Collective editors and moderators at their discretion may edit or remove your content. Only Photo Collective staff determine whether your content will be published.
3.3 You acknowledge that your content is accurate and reflects actual people and events and you did not digitally alter images or footage in any way to impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
3.4 You acknowledge that your content is not being provided for a commercial purpose.
3.5 On providing your content to Photo Collective for publication in any media, you indemnify Photo Collective and its officers, employees and agents against any damage or loss made against or suffered by any of those indemnified arising, in whole or in part, as a result of the publication by Photo Collective or a person permitted by Photo Collective of your content; or a breach by you of these terms and conditions.
4. Rights
4.1 All copyright of Images remains with the Artist.
4.2 The Promoter asserts no claims to the rights of any Image hosted on the Website other than those produced directly by the Promoter.
4.3 If the Promoter uses any Images through the Website or social media channels the Artist will be credited. Artists supplying Images consent to the use of their Images in this way.
4.4 At any time, if an Artist decides they do not want their Image used, the Promoter will oblige.
4.5 It is the Artist’s responsibility to protect their Images from infringement by third parties by entering, at a minimum, metadata into the image. The Promoter will not be liable for any third party misuse of Images.
4.6 Each Artist acknowledges that the Promoter is under no obligation to use their Image.
4.7 The Promoter reserves the right to remove Images, Posts or the Website in it’s entirety with no notice to Artists.
5. Subscriptions and Submissions
5.1 By authorising a subscription, you acknowledge that you have read, fully understand, and accept, the following terms and conditions of Photo Collectives credit/debit card and direct debit auto-renewed recurring subscription service. We will not proceed with your subscription transaction without your authorisation.
5.2 You acknowledge that the credit/debit card account or the direct debit bank account you are using for this purchase is yours, or that you have authority to use it, and that it is not fraudulently obtained. You also acknowledge that all the details you have provided to establish your Photo Collective account are accurate, and are either yours, or you have authority to use them, and they aren’t fraudulently obtained or used.
5.3 You give Photo Collective authorisation to charge your nominated credit/debit card account or direct debit bank account annually, as set out in the terms of the subscription you are purchasing, until you request it to be stopped, or your card or account expires.
5.4 You may voluntarily stop your subscription at any time by cancelling your subscription through your User Portal or by contacting our customer service department (hello@photocollective.com.au) with written notice.
5.5 Your nominated account will not be charged for anything other than the subscription products you are currently purchasing, and your financial and/or personal details will not be provided to anyone or any organisation outside of Photo Collective and its financial institution partners for any purposes other than to process this recurring subscription.
5.6 We reserve the right to cancel your auto-renewed recurring subscription at any time, and in doing so will refund any credit owing for any unfulfilled portion of your subscription to the nominated credit/debit or bank account used to establish your auto-renewed recurring subscription service.
5.7 Magazine Submissions must be provided to the specification outlined on the Website.
5.8 Not all Submissions are included in the Magazine. Photo Collective reserves the right to curate content.
5.9 If a Submission is selected. Photo Collective will seek high resolution imagery and discuss payment.
